User Agreement

Donor Agreement

By creating a Donor account and/or listing an item on iMediShare, I agree to the following:

• Ownership & Right to Give. I am the lawful owner of the item(s) I list, or I have the legal right and authority to give them away, and the item(s) are not stolen, subject to a lien, or under any other legal restriction.
• Honest & Complete Disclosure. I will accurately describe the item's condition, age, known defects, prior use, and any known safety issues or manufacturer recalls. I will not misrepresent the condition or functionality of any item.
• No Recalled or Banned Items. I will not list any item that I know to be subject to an active FDA or manufacturer recall, or that is otherwise illegal to distribute.
• Cleaning & Basic Safety. I will clean/sanitize the item to a reasonable standard appropriate to its type before transferring it, and disclose if I have not done so.
• No Guarantee by Platform. I understand iMediShare does not inspect, certify, or warrant my listed item in any way, and is acting solely as a venue for me to connect with a potential seeker.
• As-Is Transfer. I understand and agree that any item I donate is given “AS IS,” with no warranty from me or from iMediShare, unless I explicitly state otherwise in writing directly to the seeker.
• Release of Liability. I release iMediShare from any and all liability, claims, or damages arising from my donation, including but not limited to any injury, harm, or loss experienced by the Seeker or any third party in connection with the item I donated.
• Indemnification. I agree to indemnify and hold harmless iMediShare from any third-party claims arising out of items I have listed or donated.
• No Compensation. I understand this is a donation/giveaway platform, not a sales platform, and I will not request or accept payment in violation of the Platform's policies.
• Compliance with Law. I will comply with all applicable federal, state, and local laws regarding the donation of medical equipment.

Seeker Agreement

By creating a Seeker account and/or requesting an item on iMediShare, I agree to the following:

• Assumption of Risk. I understand that equipment obtained through iMediShare is used, donated “AS IS,” and has not been inspected, certified, sterilized, or warrantied by iMediShare. I voluntarily assume all risks associated with accepting and using such equipment.
• Consult a Professional. I understand that iMediShare does not provide medical advice, and I agree to consult a qualified healthcare professional before using any medical device or equipment obtained through the Platform, particularly for equipment involving respiratory support, mobility, wound care, or other clinical functions.
• Independent Inspection. I am responsible for inspecting any item before use and for verifying, to the extent possible, that it has not been recalled, is not damaged, and is appropriate for my intended use.
• No Reliance on Donor Statements Alone. While I may rely on the Donor's description in good faith, I understand iMediShare has not verified the accuracy of any listing, and I accept items at my own risk.
• Release of Liability. I release iMediShare, and to the extent permitted by law, the Donor, from any liability for injury, illness, damages, or loss resulting from my use of any item obtained through the Platform, except in cases of intentional misconduct or fraud.
• Indemnification. I agree to indemnify and hold harmless iMediShare from any claim arising from my use, misuse, or resale of any equipment obtained through the Platform.
• No Resale. I agree not to resell, for profit, any item obtained through iMediShare without the express written consent of the Platform. I understand that these supplies are donated, have no commercial value, and therefore I will not sell or exchange these items for profit.
• Compliance with Law. I will comply with all applicable laws in my use of equipment obtained through this Platform.
